Tree Preservation Act 1993

Please note: Your application may be returned or delayed if you do not enclose/disclose the necessary information, photographs and do not complete all sections as indicated in the guidance notes.

For applications containing more than 20 trees or where circumference measurements are not practicable please contact the Department for advice prior to submitting your application.

Please have the following prepared in advance:

  • An annotated map/plan showing the location of the tree(s) in relation to nearby identifiable features (e.g. a building, road, field boundary or watercourse). This does not necessarily require a formal scaled location or site plan but it should be sufficient to identify the tree(s) on the ground.
  • Photographs which (i) clearly indicate the tree(s) for removal within the context of the surroundings and (ii) illustrate the reason for removal e.g. decays points, poor tree health, or proximity to structures.
  • Details of the tree(s) i.e. a description of the tree(s) location and circumference at height of 1.5m from the ground
 

An application to carry out work on trees must be made by someone who has sufficient ‘interest in the land’ as to allow them to effectively exercise rights of ownership over the tree(s). If you are a freehold owner of the land on which the tree stands then this is simple. In other situations, more detail about your relationship to the land will required before the Department can accept your application.
