Introduction

If you have received a parking ticket, you may challenge it online or in writing.

Acceptable reasons for a challenge

Below are the only grounds (reasons) on which the Department may cancel a parking ticket.

  • The alleged contravention did not occur. 
  • For example –
  • the lines and/or signs were wrong
  • the events alleged did not happen
  • the vehicle was entitled to park
  • loading or unloading was taking place
  • a passenger was boarding or alighting
  • a valid Blue Badge was displayed
  • a valid pay and display ticket or permit was displayed
  • I was not the driver or owner/keeper of the vehicle at the time of the contravention
  • You are a hire firm, and can provide evidence that the hirer signed an appropriate liability form.
  • I have already paid the fine.
  • The Traffic Regulation Order (TRO) is invalid.
  • Compelling reason(s).
  • For example –
  • where the details on the parking ticket are incorrect, such as location
  • when you were dealing with a health related emergency situation (note: evidence will be required to support this, such as a letter from a GP)

Reasons why a challenge may fail

There are many reasons why a challenge may fail.  A common reason why a challenge may fail is if it relies solely on any of the following factors –

  • There was nowhere else to park
  • I thought I could park there at that time
  • Other vehicles were parked there when I arrived
  • I did not see the lines or sign(s)
  • I forgot to display my parking disc/ticket/permit
  • I got a ticket and no one else did
  • It was a genuine mistake
  • I disagree with the parking restrictions

What happens next?

Once you challenge a parking ticket, the Department will review the information you have provided. This includes a review of the photographs taken at the time of the alleged offence and any evidence you have provided to support your challenge.  You will receive a reply in writing with the outcome.
